The Ninth Circuit denied a petition for review of an administrative order dismissing employment discrimination and retaliation claims under the Immigration Reform and Control Act.
Zajradhara filed a complaint alleging discrimination based on national origin and citizenship status, and retaliation, under the Immigration Reform and Control Act. The Administrative Law Judge dismissed the complaint. Zajradhara petitioned for review.
The court’s reasoning
The court found the national origin claim overlapped with a Title Seven charge. The court found the selected candidate had superior qualifications. The court found no evidence Zajradhara applied for the position he claimed retaliation for.
What it means going forward
Employment discrimination claims under the Immigration Reform and Control Act must not overlap with Title Seven charges filed with the Equal Employment Opportunity Commission.
