Background
Jerry Baker pleaded guilty to nine counts of drug trafficking involving large quantities of marijuana in Cleveland, Ohio. He was the leader of a drug organization that sold marijuana from a tire shop he owned and from his residence. In November 2022, Baker drove to a bar called Aura Social Club with a knife to collect a drug debt from a victim. When the victim exited through a back door, Baker threatened the person who helped the victim escape, stating he would treat him like an opponent or a bitch and would torture him. Based on this conduct, the district court applied a sentencing enhancement for making credible threats of violence and sentenced Baker to one hundred sixty-eight months in prison and four years of supervised release.
The court’s reasoning
The court affirmed the judgment, finding the sentence procedurally and substantively reasonable. Regarding the enhancement for credible threats, the court held that the district court could rely on intercepted call transcripts that reflected Baker’s admissions and corroborating details, satisfying the minimum indicia of reliability standard. The court found that Baker’s statements to a third party about torturing the victim, combined with his possession of a knife, constituted a credible threat. On substantive reasonableness, the court noted that the sentence was within the Guidelines range and that the district court explicitly considered mitigating factors such as Baker’s upbringing and criminal history, while weighing them against aggravating factors including his role as a drug organization leader and the discovery of firearms and drugs at his premises.
For the reasons set forth below, we AFFIRM the judgment of the district court.

What it means going forward
This decision reinforces that intercepted call transcripts containing admissions and corroborating details are sufficient to support sentencing enhancements for credible threats of violence. It also clarifies that district courts need not provide a formulaic point-by-point refutation of mitigation arguments if they explicitly consider relevant factors and explain their reasoning.
