Najib A. Hodge, proceeding pro se, filed an action in the United States District Court for the District of Arizona alleging race discrimination under 42 U.S.C. § 2000a, the federal public accommodations statute, against Home Depot and unknown parties. The district court dismissed the action. Hodge appealed the dismissal to the Ninth Circuit. On appeal, Hodge did not specifically challenge the legal or factual grounds upon which the district court relied for its dismissal decision in his opening brief. Additionally, Hodge raised a new contention that the district judge was biased and should have recused himself, but provided no evidentiary support for this claim in the appellate record.
The panel addressed two primary issues. First, regarding the dismissal of the underlying action, the court applied the rule that claims not actually argued in an appellant's opening brief are deemed abandoned. Citing Independent Towers of Washington v. Washington and Acosta-Huerta v. Estelle, the court held that it would not consider the district court's grounds for dismissal because Hodge failed to challenge them in his opening brief. This procedural default prevented the appellate court from reviewing the merits of the § 2000a claim or the dismissal rationale. Second, the court addressed Hodge's contention that the district judge was biased. The panel rejected this argument, stating it was unsupported by the record. The court found no evidence in the appellate file to substantiate the claim of judicial bias or the request for recusal.
The district court's dismissal of Hodge's race discrimination lawsuit against Home Depot stands. Because the appellate court did not reach the merits of the § 2000a claim due to the abandonment of arguments, the underlying dismissal remains in effect. Hodge's claim of judicial bias was also rejected, leaving the district judge's conduct unchallenged. The decision reinforces the strict requirement for pro se appellants to explicitly argue all issues in their opening briefs to avoid waiver.
