Background
Jensen Arocho-Rodríguez, a former System Technician Coordinator for the Municipality of Aguadilla and a member of the New Progressive Party, alleged that Mayor Julio Roldán Concepción and his appointees retaliated against him for his political affiliation. The plaintiff claimed the defendants cut his server access, gave him a poor evaluation, and created a hostile work environment, forcing him to resign. He sued the defendants under Section nineteen eighty-three of Title forty-two of the United States Code, alleging violations of the First Amendment and the Fourteenth Amendment. The court’s reasoning
The First Circuit reviewed the grant of summary judgment de novo. The court rejected the argument that the plaintiff waived his First Amendment claim by failing to fully develop his legal arguments, noting that the district court has an independent duty to examine the record for genuine disputes of material fact. The court found that the plaintiff’s deposition testimony, which was incorporated into the defendants’ statement of facts, provided evidence that the defendants knew of his political affiliation and were involved in the adverse employment actions. The court also held that the district court erred in dismissing the entire case sua sponte without providing notice to the plaintiff regarding the municipal liability and official capacity claims, which were not the subject of the summary judgment motion. The court concluded that the plaintiff was procedurally prejudiced by the lack of notice and the dismissal of claims he had not been given a chance to defend against.
What it means going forward
The case is remanded to the district court for further proceedings. The plaintiff may now proceed with his claims against the municipality and the defendants in their official capacities, as the lower court’s dismissal of these claims was reversed.
