The United States Court of Appeals for the Fifth Circuit dismissed an appeal regarding the revocation of supervised release. The court found the case moot because the defendant had completed his sentence and been released from custody.
John Michael Juarez appealed his sentence following the revocation of his supervised release. During the pendency of the appeal, Juarez completed the sentence imposed upon revocation and was released from custody.
The court’s reasoning
The court determined that because no additional term of supervised release was imposed and the defendant had been released from custody, the instant appeal was moot. The court cited Spencer versus Kemna to support the finding of mootness.
