The Eleventh Circuit dismissed an appeal from a district court order compelling arbitration and administratively closing the case. The court held that the order was not final because it stayed proceedings rather than terminating the action.
Background
In August two thousand twenty-five, Brian Evans filed a complaint against StubHub, Inc. regarding tickets purchased from the company. StubHub moved to compel arbitration based on its user agreement. The district court granted the motion, stayed the proceedings, and administratively closed the case.
The court’s reasoning
The court concluded that the district court’s order was not final because it stayed the proceedings rather than terminating the action. The administrative closure was consistent with a stay and did not render the order final. Under the Federal Arbitration Act and relevant circuit precedent, appeals from interlocutory orders compelling arbitration are not permitted.
What it means going forward
The appeal is dismissed, leaving the district court’s order compelling arbitration and staying the case in effect.
