The Eleventh Circuit denied Jashim Uddin's petition for review of the Board of Immigration Appeals' decision. Uddin failed to demonstrate that the Bangladeshi government was unwilling or unable to protect him from private actors.
Jashim Uddin, a Bangladeshi national and member of the Bangladesh Nationalist Party, sought asylum in the U.S. after being attacked by members of a rival political group. His application was denied by an immigration judge and affirmed by the BIA.
The court’s reasoning
The court found substantial evidence supporting the BIA’s conclusion that Uddin’s attackers were private actors and that the Bangladeshi government was not unwilling or unable to protect him. The evidence did not compel a reversal of the BIA’s decision.
What it means going forward
Uddin’s petition for asylum and withholding of removal remains denied, and he is subject to removal from the United States.
