Background
Duly Esther Sanchez-Rivera, a Honduran citizen, petitioned for review of an order by the Board of Immigration Appeals. The Board had dismissed her appeal from an immigration judge’s decision that denied her asylum and withholding of removal.
The court’s reasoning
The court found no basis to grant the petition. It concluded that Sanchez-Rivera failed to exhaust and waived her challenges to the agency’s determinations that she did not demonstrate harm on account of a cognizable particular social group. Because the failure to establish a nexus to a cognizable social group is dispositive of her asylum claim, the court declined to consider challenges involving past persecution and a well-founded fear of future persecution. The court further held that because she did not meet the standard for asylum, her claim for withholding of removal necessarily failed.
