Background
Reginald L. Dunahue filed a lawsuit under 42 U.S.C. Section 1983 against various state officials, including wardens and captains at the Cummins Unit and Tucker Max facilities of the Arkansas Department of Corrections. Dunahue appealed the district court’s order denying his motion for summary judgment and granting summary judgment for the defendants.
The court’s reasoning
The court conducted a de novo review of the record. It agreed that the official-capacity damages claim was barred by sovereign immunity and the official-capacity injunctive relief claim was moot. The court further concluded that Dunahue failed to meet his burden to produce evidence sufficient to support his individual-capacity failure-to-protect claim. Because the court agreed that Dunahue failed to prove defendants violated his Eighth Amendment rights, it declined to address the issue of qualified immunity.
What it means going forward
The judgment is affirmed, leaving the district court’s dismissal of the claims in place.
