The Tenth Circuit affirmed the district court’s judgment upholding Defendant Phillip Eugene Wallace, Jr.’s conviction and sentence for possession of a firearm in violation of 18 U.S.C. § 922(g)(1). The court held that Wallace’s as-applied Second Amendment challenge to the statute lacks merit because Supreme Court and Tenth Circuit precedent foreclose his arguments. Specifically, the court relied on its prior decision in *Vincent v. Bondi*, 127 F.4th 1263 (10th Cir. 2025), which reaffirmed that the Second Amendment does not render § 922(g)(1) unconstitutional for felons, and noted that this holding remains valid in light of *United States v. Rahimi*, 602 U.S. 680 (2024). The court also cited *Rocky Mountain Gun Owners v. Polis* and *United States v. Warner* as controlling authority. Consequently, Wallace’s conviction and the district court’s sentence of thirty months’ imprisonment and three years’ supervised release remain in effect.
