The Seventh Circuit affirmed the district court’s order confirming an arbitration award against Elmar Hotel Management, LLC and related entities for violating a collective bargaining agreement (CBA) by housing migrants without using Union employees. The court held that the Employers waived any objection to the arbitrator’s authority to bind non-signatory parties because they participated in the arbitration proceedings with shared counsel without explicitly reserving the right to challenge arbitrability. Furthermore, the court applied the highly deferential standard of review for labor arbitration awards, which permits vacatur only if there is “no possible interpretive route” for the award within the contract’s language. The court found that the arbitrator’s determinations regarding whether the facility operated as a “hotel” and whether multiple entities constituted a “single employer” were rooted in the CBA’s definitions and the parties’ extensive submissions, rather than outside policy or law. Consequently, the Employers’ arguments regarding due process violations, improper burden shifting, and public policy concerns were rejected, leaving the arbitration award confirming liability against all named Employers intact.
