The seventh-circuit affirmed the jury’s award of nominal damages to Black & Veatch Construction, Inc., reversed the district court’s grant of summary judgment regarding The Boldt Company’s claim for wrongful termination, and remanded the case for further proceedings on that liability issue. The appellate court held that the district court did not abuse its discretion in admitting evidence relevant to credibility and damages, allowing expert testimony that elaborated on disclosed opinions, or instructing the jury that nominal damages were appropriate if Black & Veatch failed to provide a reasonable basis for computing costs under Illinois law. The court found no error in denying a new trial because the record supported the jury’s conclusion that Black & Veatch’s cost-coding evidence was unreliable and speculative. However, regarding Boldt’s cross-appeal, the court determined that the subcontract was ambiguous as to whether Boldt was automatically liable for delays absent specific notice procedures, creating a material dispute of fact that precluded summary judgment on the wrongful termination claim. Consequently, the case is remanded for a new trial on liability to determine if Black & Veatch had cause to terminate Boldt, while the existing jury verdict on damages remains in effect should Black & Veatch prevail on liability.
