The Ninth Circuit denied the petition for review of an order by the Board of Immigration Appeals (BIA) that summarily dismissed a noncitizen’s appeal and subsequently denied his motion to reconsider. The court applied an abuse of discretion standard, holding that it must uphold the BIA’s ruling unless it acted arbitrarily, irrationally, or contrary to law. The court found no error in the summary dismissal because the petitioner’s Notice of Appeal failed to meet the BIA’s strict specificity requirement; it provided only a “meager description” of grounds and left the Board guessing at the specific errors alleged by the Immigration Judge without providing supporting legal authority. Because the BIA did not err in dismissing the appeal, the court further concluded that the denial of the motion to reconsider was also proper, as the motion relied solely on the same alleged error. As a practical consequence, the petition is denied, the temporary administrative stay of removal is lifted, and the petitioner’s motion to stay removal is denied.
