The ninth-circuit granted the petition for review and remanded the case to the Board of Immigration Appeals (BIA) for further proceedings. The court held that the BIA abused its discretion by summarily dismissing the petitioner’s appeal without providing a reasoned explanation for denying his motion to accept an untimely filed brief. Under federal regulations, the BIA has discretion to consider late-filed briefs, but administrative law principles require the agency to offer a “reasoned explanation” for its decisions to allow for meaningful judicial review. The court found that the BIA’s statement that the petitioner’s explanation was merely “insufficient,” without elaborating on why it failed to meet the standard, constituted an insufficient justification. Consequently, the summary dismissal based solely on the untimely filing was vacated.
