The court held that Bounds’s Sixth Amendment right to present a defense was not violated because trial counsel did not concede guilt but instead argued for acquittal based on a lack of intent, which aligned with Bounds’s theory that he intended to turn evidence over to law enforcement rather than trafficking drugs. The court further ruled that the district court did not abuse its discretion by denying an evidentiary hearing, as the motion and case records conclusively showed Bounds was entitled to no relief. Additionally, the court dismissed the portion of the appeal regarding the denial of access to pro se letters, concluding that whether Rule 7(c) of the Rules Governing § 2255 Proceedings was violated fell outside the scope of the certificate of appealability. Consequently, Bounds’s conviction and sentence remain in effect.
