Second, the court found that both the Immigration Judge and the Board abused their discretion by denying a motion for a continuance based on Garcia-Chilel’s intent to seek a U visa. The court applied the standard requiring agencies to consider two primary factors: (1) the likelihood that the noncitizen will receive the collateral relief, and (2) whether that relief will materially affect the outcome of the removal proceedings. The court determined the agency failed this requirement by relying on irrelevant or secondary factors, such as the lack of jurisdiction over the U visa application and the speculative nature of pending applications, rather than analyzing the primary factors of likelihood and material impact.
