The Fifth Circuit granted a petition for rehearing en banc on its own motion, vacating the panel opinion issued on July 2, 2026. A majority of the circuit judges in regular active service voted to rehear the consolidated immigration cases involving Ignacio Sosnava Rodriguez, Alejandro Villegas Angel, and Miguel Angel Gomez Alvarado. The court ordered that the case be reheard with oral argument at a later date and directed the Clerk to specify a briefing schedule for supplemental briefs pursuant to Fifth Circuit Rule 41.3. Consequently, the previous panel decision is nullified, and the proceedings will resume under the full bench of the circuit judges.
