The Fifth Circuit granted Google’s petition for a writ of mandamus, ordering the district court to transfer the lawsuit filed by Branch Metrics Inc. to the Northern District of California. The court held that the district court plainly abused its discretion in calculating and balancing the factors governing venue transfer under 28 U.S.C. § 1404(a). Consequently, the court withdrew its prior opinion and substituted this new ruling, directing the immediate issuance of the mandate to effectuate the transfer.
