The federal-circuit denied the petitioner’s motion for leave to file a petition for a writ of mandamus directed at the Merit Systems Protection Board. The court held that a writ of mandamus is an extraordinary remedy available only when a petitioner demonstrates a clear and indisputable right to relief and the absence of any other adequate means to attain the desired relief. The court found that the petitioner failed to meet this standard because he did not show that the normal appellate process—seeking review after the Board issues a final decision—was inadequate, nor did he demonstrate that any delay by the Board was so egregious as to warrant such relief. Consequently, while the motion is granted solely to the extent necessary to docket and deny the petition due to a filing restriction imposed on the petitioner in another court, the underlying request for mandamus relief is denied without addressing the merits of the whistleblower appeal.
