The eleventh-circuit dismissed the appeal sua sponte for lack of jurisdiction because the notice of appeal was filed prematurely. The court held that a magistrate judge’s report and recommendation is not a final, appealable order until it is adopted by the district court; since the appellant filed her notice of appeal before the district court adopted the recommendation, the subsequent adoption did not cure the defect. Consequently, the court denied all pending motions as moot.
