The Eighth Circuit affirmed the conviction and sentence of Calvin Shawn Carter, who pleaded guilty to production and possession of child pornography and received a 324-month prison term. The court held that the district court did not commit clear error in applying a two-level sentencing enhancement under U.S.S.G. § 2G2.1(b)(5) because the minor victim was in Carter’s “custody, care, or supervisory control.” Applying de novo review to the legal interpretation of the Guidelines and clear error review to the factual findings, the court determined that the primary consideration is the nature of the relationship between the defendant and the minor. The record supported the finding that Carter temporarily assumed custody of the 13-year-old victim at the parents’ request, including taking the child to his home overnight and assigning him chores, which satisfied the requirement for temporary caretaking under U.S.S.G. § 2G2.1 comment. (n.5(A)). Consequently, Carter’s sentence remains in effect as affirmed by the appellate court.
