The United States Court of Appeals for the Fourth Circuit affirmed the district court's dismissal of an employment discrimination complaint filed by David Arevalo against multiple corporate and individual defendants.
David Arevalo filed a civil complaint in the United States District Court for the Eastern District of Virginia alleging employment discrimination and state-law tort claims against Akima, LLC and other defendants. The district court dismissed the complaint and denied relief sought in a sur-reply. Arevalo appealed the orders to the Fourth Circuit.
The court’s reasoning
The panel reviewed the record and discerned no reversible error in any aspect of the district court’s dispositive rationale. The court determined that the facts and legal contentions were adequately presented in the materials before the court.
What it means going forward
The dismissal of the underlying employment discrimination and tort claims stands, ending the litigation in favor of the defendants.
