The Fourth Circuit granted Elena Garcia-Chilel’s petition for review, vacated the Board of Immigration Appeals’ order, and remanded the case for further proceedings. The court held that the immigration agency erred in two specific respects. First, regarding a defective Notice to Appear that lacked a date and time for the hearing, the court ruled that while this error did not strip the immigration court of adjudicatory authority, Board precedent requires such an error to be remedied when timely raised; therefore, the agency must determine the appropriate remedy in the first instance. Second, the court found that both the Immigration Judge and the Board abused their discretion by denying a motion for a continuance based on Garcia-Chilel’s intent to seek a U visa. The court applied the standard requiring agencies to consider two primary factors: (1) the likelihood that the noncitizen will receive the collateral relief, and (2) whether that relief will materially affect the outcome of the removal proceedings. The court determined the agency failed this requirement by relying on irrelevant or secondary factors, such as the lack of jurisdiction over the U visa application and the speculative nature of pending applications, rather than analyzing the primary factors of likelihood and material impact.
