The eighth-circuit affirmed the defendant’s conviction and 120-month sentence for possessing with intent to distribute more than 5 kilograms of cocaine in violation of 21 U.S.C. §§ 841(a)(1) and (b)(1)(A)(ii). The court held that any alleged errors regarding the district court’s denial of safety valve relief under 18 U.S.C. § 3553(f) or application of U.S.S.G. enhancements for dangerous weapons and aggravating role were harmless because the district judge explicitly stated on the record that he would have imposed the same sentence regardless of those rulings. Applying the standard from *United States v. Straw*, 616 F.3d 737 (8th Cir. 2010), the court concluded that incorrect application of the Guidelines is harmless error when the district court specifies that the resolution of a particular issue did not affect the ultimate determination of the sentence. The judgment of the district court remains in effect.
