The Ninth Circuit affirmed the 13-month sentence imposed on Jeremiah Robert Wiberg for failure to register as a sex offender in violation of 18 U.S.C. § 2250(a). The court held that any breach of the plea agreement by the government, which initially failed to recommend a sentence at the low end of the guideline range, was remedied when the district court reopened sentencing proceedings and reduced Wiberg’s term from 16 to 13 months. Regarding Wiberg’s claim that the government’s prior arguments prejudiced his request for a downward departure under U.S.S.G. § 5K2.23, the court found no abuse of discretion because the district court considered Wiberg’s history solely to determine whether to adjust the sentence for time served on separate supervised release proceedings pursuant to U.S.S.G. §§ 5G1.3(b) and 5K2.23. Applying the abuse of discretion standard established in *Gall v. United States*, the court concluded that no further reduction was warranted. The practical consequence is that Wiberg’s conviction and sentence remain in effect as affirmed by the appellate panel.
