Coverage

Court: United States Court of Appeals for the Ninth Circuit

Filed: 2026-06-24

Docket: 2:23-cr-00047-TOR-2

The Ninth Circuit affirmed the judgment of conviction and sentence for conspiracy to distribute controlled substances, distribution of methamphetamine, possession with intent to distribute, and possession of a firearm in furtherance of a drug trafficking crime following an independent review of the record under *Penson v. Ohio*. The court found no non-frivolous arguments for appeal after counsel filed a brief under *Anders v. California* stating that no such arguments existed, and the appellant failed to file a pro se supplemental brief. Consequently, the court denied the defendant’s pro se requests to appoint new counsel and granted counsel’s motion to withdraw.
