Background
Ernest Shropshire pleaded guilty to conspiracy to possess with intent to distribute methamphetamine and fentanyl, and to distribution of those drugs. He operated as a supplier in Akron, Ohio, selling pounds of methamphetamine and fentanyl to local dealers. The district court sentenced him to one hundred twenty-one months in prison, an above-Guidelines sentence, after finding he was a large-scale trafficker with an extensive criminal history including aggravated robbery and domestic violence.
The court’s reasoning
The court reviewed the sentence for procedural and substantive reasonableness. It determined the district court’s upward adjustment was a variance based on Section three five five three factors, not a departure under Section four A one point three, so the specific requirements for departures did not apply. The court found the sentence procedurally sound because the district court calculated the Guidelines range correctly, treated them as advisory, and adequately explained its decision.
